Contact DMV / Request Administrative Hearing

To request a hearing with the California Department of Motor Vehicles (DMV) Driver Safety Office to contest the automatic suspension of your driving privileges, you can:

  1. Request a hearing within 10 days: You must request a hearing within 10 days of receiving notice of the action against your driving privilege.
  2. Contact a DMV Driver Safety Office: You can contact the Driver Safety Office nearest to your home.
  3. Identify yourself: You must identify yourself by your full name, driver license number, and date of birth.
  4. Verify your mailing address: You must verify your correct mailing address.
  5. Prepare your argument: You should outline your argument concisely and logically, focusing on the key points that demonstrate why your driving privileges should not be suspended or revoked.

The DMV will:

  • Schedule the hearing
  • Provide you with copies of any evidence in its possession
  • Permit you to prepare your case
  • Require you to introduce a wide range of evidence

Regardless of whether the person has a California driver’s license or a driver’s license from another state, there are only ten (10) calendar days from the date of the California DUI arrest within which to request a Hearing with the California Department of Motor Vehicles Driver Safety Office to contest the automatic suspension of driving privileges. Failure to request a DMV Hearing within ten (10) calendar days of the DUI arrest ordinarily waives the right to a hearing and will result in an automatic suspension thirty (30) days from the date of the arrest for a minimum of four (4) months.
